For more than 25 years, court watchdogs have been baffled by Baugh's unusual record of success.
In addition, an audit of Baugh case dockets reveals that the veteran lawyer somehow manages to file and have heard an improbable number of "ex parte" motions that do not involve the risk of great or irreparable injury.
The ex parte motion process - which severely restricts the ability of an opposing party to respond to and contest the motion - by law requires a showing that great or irreparable injury would result to the petitioner before the matter can be heard on notice.
"Because the notice requirement of motions are designed to ensure the fairness of the procedure, ex parte applications are highly disfavored and granted only if absolutely necessary...Judges hate unnecessary ex parte applications." Sacramento County Public Law Library.But judges do not appear to hate unnecessary ex parte applications when they are filed by Baugh. Court records indicate that Baugh routinely uses the ex parte process illegally, as a bad faith litigation tactic.
Court whistleblowers have long speculated that Baugh gets away with his flagrant disregard of the law because he has compiled a dossier of compromising information on many Santa Clara County judges. And now, a new whistleblower alleges that Judge Patricia Lucas and Judge James Towery also receive bribes: cash payments made through intermediaries of Baugh. Which would explain a lot.
